CASE INVOLVEMENT

The issues have been many and various, as have been the clients.

Representation ofValuation Officers, local authorities and ratepayers of all kinds.  The properties have ranged from show homes to sewage treatment plants, from places of public religious worship to a casino, leisure centres to bus garages, cold stores to  district heating centres, courts, drug rehabilitation centres, educational establishments, parks, stately homes, banks, boathouses, pubs, ports, restaurants and shops of all stripes.  And these are only the cases which have been reported: most cases settle; and  so details of office cases (one of which has lasted for fifteen years), heavy industrial plants, pipelines and tank farms, crematoria and the agricultural exemption, remain unsung save in the minds of those who fought them. There are some collection cases listed.  Again, these are the tip of the iceberg, as the vast majority of such cases are disposed of, either by agreement or at first instance (and are thus unrecorded).

Some of these cases are seminal, however.  In particular, K Shoes brought about the antecedent valuation date, and Imperial College brought about fundamental changes in the way in which a contractor’s test valuation is carried out.  Chetnik effectively expanded ratepayer protection against demands for a rate which there was no right to demand and no obligation to pay.  Hodgetts/Huelin forced Valuation Officers into a wider set of criteria for the issue of transition certificates.  Perhaps the longest-lasting in its effect will be Scottish and Newcastle, which defeated an attempt by the Valuation Office Agency to change the basis of all valuations from the actual mode or category of use (the rebus sic stantibus” principle) to that of the highest and best use to which a hereditament could be put.
